With the introduction of modern awards on the 1st January 2010, it has never been more imperative that businesses consider the appropriateness of the awards and workplace instruments which apply to them. The Fair Work Commission maintains a strong focus on workplaces engaging in enterprise bargaining to determine appropriate terms and conditions of employment for the individual workplace. This is designed to result in a more connected and productive workplace with regards to conditions of employment.
The Chamber of Commerce NT supports employers in developing enterprise agreements which take into account their individual needs and practices, ensuring a tailored agreement and process. Management of the negotiation process with employees and representatives, included Unions is providing to ensure implementing an enterprise bargaining agreement remains as stress free as possible.
The Chamber of Commerce has experienced, qualified and accredited Mediators able to resolve workplace disputes through mediation. The principles of alternative dispute resolution are used in addressing issues with a focus on achieving the best negotiated outcomes at the workplace level. Mediators are accredited with LEADR.
Unfair Dismissal and General Protections Dismissal Claims:
Terminating an Employee may not always go to plan. The Chamber of Commerce NT provides case management support for underperforming employees and advice on how to appropriately handle misconduct in the workplace. Termination may be necessary and it is imperative for businesses to equip themselves correctly with the best advice in effecting a termination in helping to minimise the risk of a claim for unfair dismissal or general protections (unlawful) dismissal against an employer.
The Chamber of Commerce NT can represent your business in the defence of an unfair dismissal or general protections claim with the Fair Work Commission.
Discrimination, Sexual Harassment and Equal Opportunity Issues:
Allegations of discrimination and sexual harassment often arise in the workplace. It is imperative that businesses take claims seriously and respond immediately. Assistance available includes external investigations into claims to determine recommendations addressing how businesses should handle these situations.
Workplace Relations Advisors are available to represent businesses who may have had claims filed against them with the Northern Territory Anti-Discrimination Commission or Human Rights & Equal Opportunity Commission. Assistance is provided so that businesses understand the claims against them and how best to respond.
Fair Work Ombudsman investigations and underpayment claims:
The role of the Fair Work Ombudsman is to ensure compliance with the Fair Work Act 2009. The primary education tool used to ensure employers comply is to use industry-wide audits to address issues in relation to non-compliance with award conditions resulting in underpayments or incorrect record keeping practices. The Fair Work Ombudsman will additionally pursue underpayment claims on behalf of employees against employers.
Employers who are subject of an underpayment investigation should seek advice immediately upon notification of an investigation. Ensuring you are represented appropriately will save you money and your reputation in ensuring matters are handled properly so your story doesn't end up in the newspaper, serving as a warning to others.

Workplace Health & Safety Consultancy Service:
The Chamber of Commerce NTprovides advice on workplace health and safety, offerring WHS consultancy services. These include:
- NT specific training for business owners, managers, supervisors and elected health and safety representatives
- Advice on NT OH&S legislation as it affects businesses
- Assistance with implementation of safety management systems
- Review of existing safety management systems
Resolution of Industrial Disputes:
The Chamber of Commerce's experienced Workplace Relations Advisors can effectively resolve your industrial dispute, quickly and effectively, returning your workforce’s productivity in the workplace.
